Every other compliance risk in aesthetic marketing involves a regulator who found you. This one involves a patient who liked you — right up until they tried to cancel.
Memberships are good business: predictable revenue, higher lifetime value, a reason to come back monthly. Nothing here argues against them. But a membership that bills automatically is a negative-option offer, and that carries specific obligations.
The federal baseline — the Restore Online Shoppers' Confidence Act — asks for three things before you charge a recurring fee online:
Most states layer their own automatic-renewal statutes on top, and several are stricter than the federal floor. FTC rulemaking in this area has been active and contested — confirm the current position before relying on any specific requirement.
Not through bad intent. Through interface design:
| Safe | Crosses over |
|---|---|
| "$149/month, renews monthly until you cancel. Cancel anytime in your account or by email." | "$149/month" with renewal terms in the footer |
| Terms on the same screen as the payment fields | Terms on a separate page the customer must find |
| "Unused treatments remain available for 12 months" | Banked treatments that quietly expire |
| Cancellation in the same number of clicks as signup | "Call during business hours to cancel" |
Put the full terms — price, frequency, what renews, how to stop it — immediately adjacent to the signup button, in the same type size as the price. Then make cancelling genuinely easy.
Both take an afternoon. Both are exactly what an investigator looks at first. And there's a commercial argument too: members who understand what they bought complain less, charge back less, and stay longer than members who feel trapped.
